- Retail Fraud Third Degree: a misdemeanor carrying up to 93 days jail when the amount of money, or the value of the property, obtained or attempted to be obtained is less than $200.00.
Repeat offenders can have a third degree charge enhanced to second degree or a second degree charge enhanced to first degree.
